You agree that by accessing the Site you have read, understood and agreed to these Terms of Use. Ehrler & Beck Vacuum and Compressed Air Technology GmbH and you both consent to the non-exclusive jurisdiction of the courts of Baden-Württemberg. This means that you can bring claims to defend your consumer protection rights in relation to these Terms of Use in Germany or in the EU country in which you reside.
DISPUTE RESOLUTION
informal negotiations
To achieve a quick resolution and the costs of any dispute, controversy, or claim related to these Terms of Use (each, a "Dispute" and collectively, the "Disputes"), raised by either you or us (individually, a "Party" and collectively, the “Parties”), the Parties agree to first negotiate any Dispute (other than those Disputes expressly identified below) informally for at least thirty (30) days prior to initiating arbitration. These informal negotiations begin with a written communication from one party to the other party.
Binding Arbitration
Any dispute arising from the relations between the parties to this contract will be decided by an arbitrator who, in accordance with the Rules of Arbitration and the internal rules of the European Arbitration Court, which is part of the European Arbitration Center based in Strasbourg and in force at the time of the filing of the Request for Arbitration is elected and acceptance of which is deemed accepted by this clause. The seat of the arbitral tribunal is Stuttgart, Germany. The language of the proceedings is German. Applicable substantive legal provisions are those of German law.

The parties agree that any arbitration shall be limited to the dispute between the parties individually. To the maximum extent permitted by law, (a) no arbitration shall be joined to any other proceeding; (b) there is no right or authority to arbitrate any Dispute in a class action or utilizing class action procedures; and (c) there shall be no right or authority to bring any Dispute purportedly representing the public or any other person.
Exceptions to Informal Negotiations and Arbitration
The parties agree that the following Disputes shall not be subject to the Informal Negotiation and Binding Arbitration Provisions set forth above: (a) any Dispute intended to enforce or protect, or which concerns the validity of, a party's intellectual property rights; (b) any dispute arising out of or arising out of allegations of theft, piracy, invasion of privacy or unauthorized use; and (c) any request for injunctive relief. If this provision is found illegal or unenforceable, neither party will elect to arbitrate any dispute arising under that part of this provision that is found illegal or unenforceable, and such dispute will be resolved by a court of competent jurisdiction within the jurisdiction set forth above for the courts listed have jurisdiction and the parties consent to the personal jurisdiction of that court.
